Each year this topic rises from the dead. The joyful birding experience is getting harder and harder to have.
Whether it is legal or not -- and I hear this used often to justify one's actions -- doesn't matter. I don't want to see a kayak, or 20 kayaks, by a bird; or someone sitting in the field next to a hawk when I travel a great distance to see a life bird.
The birder conservationist no longer exists. Now it's about the list or the photo. Not about experiencing the bird and its actions. We all carry cameras. Most photos of birds have only sentimental value.  
I use the best scope I could buy so I don't have to get close to a bird to experience the wonder and joy it provides me. I know we all sometimes get caught up in the moment and I can remember every time I went too far and flushed a bird. Yes, it still bothers me and I try real hard to remember more birders may be on the way.
If you aren't doing anything wrong, then a photo of you on facebook won't be a big deal. In fact you will be proud, I am sure.
Birding is now a contact sport and more and more people seem to be in it for themselves and not the birds.
