LEGISLATIVE ACTIONS THIS WEEK:
HB 153 BUDGET BILL - Makes appropriations for FY 2012-2013.
On Thursday afternoon, the House Finance Committee accepted a substitute =
version of House Bill 153. Of particular note:
- Eliminate the estate tax as of January 1, 2013
- Creates a $50 million grant program per year for local governments f=
or collaboration
- Alters TPP and utility reimbursement phase-out (not real clear how b=
ut will get more info soon and share)
- Eliminates the plan to shift pension payments 2% from employers to e=
mployees
- Keeps public notice website requirement that local governments must =
use the state website, as opposed to using only the township website for =
notification HOWEVER the new bill prohibits the state from charging local=
governments a fee to use
- Removes all health care pooling language except the language requiri=
ng a study as to the feasibility of offering such a program
- Extends for one year the 25 cent waste disposal fee that goes to soi=
l and water conservation districts
- Kept LGF reductions at 25% for FY 2012 and 50% for FY 2013
- Requires newspapers to create a government rate for political subdiv=
isions
- Clarifies shared services provision to protect current contracts
- Creates designation of =E2=80=9Cfiscal caution=E2=80=9D for local go=
vernments (schools currently have the possibility of this designation)
- Permits the Auditor of State to dissolve a political subdivision tha=
t is in fiscal emergency and has met specifications
- Permits township fiscal officer to be paid by funds other than the g=
eneral fund based on work performed
- Alters new community authority laws
- Provides that, when a county board of elections incurs expenses rela=
ted to a township tax levy ballot issue, the township board of trustees m=
ay request that those expenses be withheld from the particular township f=
und to which the tax is credited
We will be preparing a document, similar to what we sent when the bill wa=
s first proposed, that lists out all sections that impact townships and a=
short description of each.
The House Finance Committee is taking public testimony on this new bill. =
The OTA will be testifying on the bill tomorrow. (Friday) The Committee=
will have hearings tomorrow (Saturday) at 10:00 am and Monday at 10:00 a=
m. If you are interested in testifying, you just need to show up and fil=
l out a witness slip. Additionally, you will need 75 copies of your test=
imony.
The House Finance Committee will likely vote the bill out on Tuesday. If=
they keep with tradition, there will probably be an omnibus amendment pr=
ior to the committee vote. We will keep you posted.
RECENTLY INTRODUCED:
HB 209 PUBLIC DEPOSITORIES (Adams, R.) To permit a political subdivisi=
on, upon the deposit of public moneys with an eligible public depository,=
to arrange for the public depository to redeposit those moneys with othe=
r federally insured banks and savings and loan associations in accordance=
with specified conditions. Am. & En. 135.18, 135.37, 135.145 and 135.354.
